TRI-MED, INC TERMS AND CONDITIONS
ORDERING and RETURN POLICY
By placing or accepting delivery of equipment, supplies, products or services as described and sold on this web site.
Customer / Purchaser agrees to be bound by and accepts these terms and conditions of sale
. You represent, warrant and agree that you are over the age of eighteen (18) years and that you have adequate legal capacity to enter into this Agreement.

To place an order, just click on the Buy KNOW button next to the product you wish to purchase, then follow the easy instructions on our Secure Ordering Cart.

Do Not send credit card information using E-Mail. E-Mail is NOT Secure.

1.) If you have any shipping Instructions or comments, please give us a call or provide them in the Special Instructions area of the Cart.
2.) Orders requiring a Doctors Prescription will ONLY be shipped after a copy of the prescription has been received by Tri-Med via Fax or Email. You or your Doctor may Fax a copy of your prescription to: 1-877-496-1646 Toll Free.
3.) Upon completion of your order via the internet, you will receive a confirmation Email of your order and a 9 digit order number. A copy of your Invoice will be sent with your order or Emailed to you.
4.) If the item you ordered is not in stock, BackOrdered, we will notify you by Email of the estimated ship date. NOTE: Please make sure your Email address is correct.

5.) Company orders must furnish a State Sales Tax Number or a Prescription for Purchases that Require a Prescription at the time of sale.

Any changes or inaccuracies must be made before the order is Shipped, our shipping time is typically within 24 to 48 Hours Monday through Friday. Additional shipping, redelivery, ALL Custom's and Duties charges are the responsibility of the purchaser. Customer assumes Full responsibility for drop shipments made to other then the purchasers billing address.

7.) Orders placed over the Internet or by Phone and charged to your Credit Card and then canceled for No Prescription, Etc. , will be subject to a service fee of a Min. $ 5.00 or a Max. 5% which ever is greater of the Total Invoice. All orders that are refused by the customer for delivery are subject to a 20% Restocking fee plus ALL shipping costs.

8.) You may cancel your order at any time before it is shipped without any service or restocking fee's. If your order has shipped, the above policy (#7) will apply. Please allow 2-3 weeks for all Credit Card refunds.

We accept most Major Credit Cards.


7.) Standard shipping is by Fed Ex Ground, we can also ship by request USPS Priority Mail (pending weight). We gladly ship to EPO and APO addresses via the Post Office, give us a call.

8.) For OverNight Shipping ONLY , Orders received BEFORE 12 Noon, MST (Denver Colorado Time) will be shipped the same day pending Prescription if Required and stock status, OverNight orders received AFTER 12 Noon MST will be shipped the next business day pending Prescription if Required and stock status. 9.) When your order is shipped, an Email advising you of delivery is sent the day your order is shipped by the carrier and or Tri-Med, do to some Email providers Emails are blocked, so we cannot guaranty you will receive this notification.

Signature is Required for Orders $25.00 or More . If you cannot be there to accept your order, Fed Ex will leave you a notice of delivery that you may sign and get delivery the next business day. If you have any problems , Please give us a call.

10.)
Shipments outside the United States are by wire transfer only, will be billed separately for Freight and Insurance. All Duties, Tariff's, Custom's Charges or any other international charges or fee's are the responsibility of the purchaser.

Tri-Med's - Return Policy *
The goal of Tri-Med is your complete satisfaction. We want you to be happy with your purchase. If, within 15 days of Invoice Date, the product purchased from Tri-Med is defective in Material and or Workmanship, and you have ALL the original packaging, parts, instructions, blank warranty cards and the product is unadulterated or altered in any way. *We will exchange the defective product with an identical item ONLY. All shipping and handling charges are the responsibility of the purchaser.

After the 15 days from the date of invoice, the manufacturer's warranty shall apply. Consult the manufacturer's warranty instructions enclosed with the product. We will be happy to assist you, just give us a call. Tri-Med does not set up or repair any of the Products sold on this web site. We do not offer 24 hour service or after hour service. For products needing on-going maintenance or backup, patients / purchaser must make arrangements with a local provider or service center at there expense.
If the defect is one that is not covered by warranty, then it is the Customer's responsibility to resolve the problem directly with the manufacturer.

OUT OF STOCK - SUBSTITUTIONS:

If an item is out of stock, we will notify you within 48 hours of your order by Email. If the order is an OverNight we will contact you as soon as possible of any delays. In cases that an item is discontinued or has been replaced, updated or is no longer available, we may at our discretion send a substitute of equal or greater value at the same price as your original order. If a substitute or replacement, etc. is not available from the same Manufacturer, we will contact you before shipping your order.

RETURNS:

You MUST have an RMA# (Return Material Authorization) number before returning any item (See policy below*) or defective product to Tri-Med, no exceptions. Please call Tri-Med or Email:
  us, we will issue you a manufacturer  RMA# via Email with Instructions

All Products Drop shipped to you direct from the manufacturer Must be returned to Tri-Med or as instructed by Tri-Med with an RMA# number from Tri-Med, clearly marked on the outside of the box.

All Returns are subject to a 20% Restocking Fee plus All Shipping Costs .
Products returned with an odor precipitated by cigarette smoke or other types of environmental odors, used (even one time), not in original packing, factory seal or plastic bags open or broken will not be accepted for return under any condition.

We strongly suggest that the Customer keep the original packaging for the duration of the warranty period. The packaging that your Product comes in is the proper packaging according to manufacturer's specifications. This packaging would be required should the Customer have to ship the machine for servicing or repairs. Failure to do so will be an expense to the Customer and the Customer will have to buy the proper box from the manufacturer.

Due to the nature of the items sold on this web site by Tri-Med, any item returned to Tri-Med without an RMA# number clearly marked on the outside of the package may be refused or destroyed at purchasers expense. We reserve the right to be the sole determiner of the definition of defective.

Upon getting your RMA# number, we suggest that you use UPS or FedEx and for your protection, return the package INSURED, SIGNATURE REQUIRED and keep your receipt. Sorry, we do not accept COD returns. Please enclose a copy of your original invoice with any information or instructions with the package and place the RMA# number on the outside of the box IN LARGE LETTERS.

REFUNDS:

All refunds are by credit back to the original credit card or credit towards future purchases as determined by Tri-Med. We do not give cash refunds. Any restocking fees, credit card charges, shipping and handling costs, are the responsibility of the purchaser and shall be deducted from the total Invoice amount.
Please allow 2-3 weeks for all credits domestically and 4-6 weeks for International orders.

* This policy does not apply to any item worn or used next to the skin or is used to dispense, deliver Oxygen or Medication.
Do to the nature of these products. NO returns or exchanges will be accepted under ANY circumstances other than for warranty repairs through the original manufacturer.

Tri-Med's - Insurance Reimbursement Policy
Tri-Med does not except any insurance payments or warrant same, for the equipment or supplies sold on this web site. We suggest that you contact your insurance carrier FIRST and ask them there direct reimbursement policy.
Tri-Med will be happy to assist you, with your approval, with any information we have that your insurance company may request. Insurance HCPC codes may be provided as a courtesy, we do not warrant the accuracy of these codes. Please check with your doctor for the correct HCPC code.

LEGAL DISCLAIMER:
Seller hereby expressly disclaims all warranties either expressed or implied warranty of merchantability or fitness for any particular purpose whatsoever. This disclaimer by the seller in no way affects the terms of the manufacturer's warranty if any. Tri-Medinc.com shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to back orders of Products, mail or shipping delays, customs delays, lost shipments, Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of Tri-Medinc.com. Tri-Medinc.com may use email to notify the Customer in the event of such delays upon its sole discretion. Customer shall be solely responsible to make other arrangements to purchase or seek alternative products. Any and All costs incurred in connection with such purchases shall be borne by Customer alone and not Tri-Medinc.com.
